General conditions for the provision of services
1. Scope and acceptance of the general conditions
Among the activities of Secundo, we act in particular as an intermediary between (prospective) buyers (hereinafter: the recipients of the services) and developers, builders and, generally speaking, sellers of property (hereinafter: the sellers), as well as with various providers and suppliers who may supply different types of services in connection with the acquisition and the fitting out of the property acquired (for example: furniture and/or appliance stores, alarm installers, sun awning installers, lawyers, etc.; hereinafter: the providers). More precisely, this is a service of putting parties in touch and of administrative facilitation, without any advisory service, in order to facilitate the purchase and the fitting out of the new property of the buyers to whom we have presented properties.
These General Conditions for the Provision of Services (hereinafter also: GCS) apply to the services provided by Secundo in connection with putting the recipients of the services in touch with sellers and providers, and more precisely to the services relating to putting (potential) buyers in touch with sellers and providers in connection with the purchase of a property.
These GCS govern in particular the scope of the services offered by Secundo, the obligations of Secundo and its role in the context of its activity as an intermediary. They are addressed to, and apply to, all persons who call upon the intermediary services of Secundo.
By calling upon the service of being put in touch with the various parties suggested, you accept these GCS without reservation; if you do not accept the GCS, please do not call upon this type of service.
The recipient of the services acknowledges having read these General Conditions for the Provision of Services (as well as the General Conditions of Use of the website and the Privacy Statement) and undertakes to comply with the obligations incumbent upon them.
As regards the information and images included on the website www.secundo.com as well as the activities linked to the use of the website, we refer explicitly to the General Conditions of Use of the website (GCU), which apply to those aspects.
The GCU and the GCS are complementary; that said, in the event of a contradiction between these General Conditions for the Provision of Services and the GCU, these GCS shall prevail.
2. Services provided and undertakings of Secundo
The services covered by these GCS are not such as to give rise to a contractual relationship between the recipient of the services and Secundo. The said services of putting parties in touch are optional and are provided free of charge.
In the context of the services of putting parties in touch, Secundo puts the recipients of the services in touch with sellers and providers, without carrying out any in-depth verification of their solvency, their capacity to perform or the viability of the projects. The (potential) buyer of a property presented by Secundo may decide not to call upon the sellers and/or the providers with whom they have been put in touch through Secundo or whom Secundo presented to them. The sole purpose of the service offered by Secundo is to facilitate the steps usually associated with the purchase of a property, and the recipient of the services is free to contract with all, some or none of the intermediaries proposed by Secundo.
Secundo undertakes, of course, to comply with the applicable legal and ethical obligations, and to use its best efforts to pass on the information received from sellers and providers in good faith, as correctly and completely as possible, without guaranteeing its accuracy, completeness or relevance. In the event of a discrepancy between the information provided by Secundo and that provided by the sellers/providers, the information provided by the latter shall prevail and shall alone be intended to bind, where applicable, the recipients of the services to the sellers and/or providers.
Secundo is bound by an obligation of means for the services offered and bears no obligation of result of any nature whatsoever.
Secundo in no case acts as a legal, tax, financial or technical adviser, and carries out no personalised analysis of the situation of the recipients of the services. The information communicated does not constitute an investment recommendation.
3. Processing of requests and/or information
The recipient of the services may provide their personal data, in particular in order to obtain information from Secundo or to be put in touch with sellers/providers.
We reserve the right to make the processing of the information conditional, to suspend it or to refuse it in the following cases:
– incomplete or incorrect information;
– Communication of data that is manifestly erroneous or even fanciful;
The list above is not exhaustive.
In any event, the personal data communicated by the recipient of the services will be processed solely in order to respond to the requests made by the latter or to provide the services requested, and the personal data of the recipients of the services will be communicated to third parties only if the recipient of the services has given their agreement or has asked to call upon the specific service of being put in touch with third parties.

4. Information provided
The service(s) and properties offered, as well as the information provided, are described and supplied in good faith, as precisely and faithfully as possible. Secundo acts diligently when collecting and passing on information of any nature whatsoever.
The images and information presented on the site (hereinafter: the information) or handed over or provided during contacts with Secundo are nevertheless given for guidance only and have no contractual value. Secundo does not guarantee the completeness, accuracy, exhaustiveness or availability of this information or of the services offered, and in particular the information concerning property listings. Secundo may therefore not be held liable for the inaccuracy of such information.
Secundo uses its best efforts to provide content of quality and as reliable as possible. However, the information published on this site or communicated concerning products and services may be incomplete, inaccurate or out of date, and Secundo gives no undertaking whatsoever to correct or update the information communicated relating to those products and services within any given period.
Secundo may make changes to the products and services offered on the site, or to the prices applicable to those products and services, at any time and without notice, without this engaging its liability.
Secundo may not be held liable for errors in the information passed on or published, including listings. Listings and information do not constitute an offer in the legal sense of the term. The information passed on must be regarded as provisional and must be confirmed by the sellers and/or providers. In this respect, the recipients of the services are required to request from the sellers and providers all the information they consider useful or necessary.
Secundo draws the attention of the recipients of the services to the fact that Spanish legislation will, where applicable, apply to transactions concluded in Spain or with Spanish parties. The applicable laws and rules may therefore differ from Belgian laws and rules, and the recipient of the services undertakes to inform themselves or to request the information they consider useful or necessary from the sellers, providers and/or any other specialist party they consider appropriate.
The recipients of the services expressly acknowledge that any investment decision is taken under their sole responsibility, after having carried out their own checks and, where appropriate, sought their own advice.
5. Good-faith use of the services
When using the site and the services, the recipient of the services is required to act with due care and is responsible for providing correct and complete information.
6. Limitation of liability
The activity of Secundo is limited to presenting sellers and providers to the recipients of the services. In the context of the services of putting parties in touch, Secundo endeavours to seek out reliable, quality sellers and providers. Likewise, Secundo will present to its partners only those recipients of services whom it believes to be reliable.
Secundo is not a party to the contracts that the recipients of the services conclude, where applicable, with the sellers and/or providers following the intermediary services of Secundo.
The decision to enter into a contractual relationship with the sellers and/or providers presented by Secundo rests entirely with the recipient of the services, and vice versa.
In addition to what is set out in article 4 of these GCS, Secundo is therefore not responsible for the acts, undertakings, failings and/or omissions of any nature whatsoever, including the financial situation or the solvency of the recipients of the services, of the sellers and/or of the providers vis-à-vis the other party.
Furthermore, Secundo may in no case be held liable, among other things, for any delays and/or failings and/or defects, in particular of construction, and/or of delivery and other obligations incumbent upon the sellers and/or the providers.
Generally speaking and in any event, Secundo may not, save in the case of wilful misconduct, be held liable for the failure to conclude a contract with a third party or for the non-performance, even partial, of obligations that would result from the inaccuracy of the information communicated, for the non-performance of obligations entered into or of contracts concluded through access to the Secundo website or through the information provided by or through Secundo, nor for any direct or indirect damage arising therefrom, for damage occurring as a result of an event of force majeure, or following an unforeseeable and/or insurmountable event or acts or failings of a third party.
Without prejudice to the foregoing, in the event that Secundo were to be held liable, on any ground whatsoever, our liability may not exceed the total amount of €2,000. Notwithstanding the foregoing, as regards the regulated activities of Secundo, its liability shall in any event and whatever the nature of the fault and/or the damage be limited to the amount covered by its professional liability insurance.
Secundo may in no case be held liable for the feasibility, the completion, the profitability or the success of a property project.
Secundo may receive a commission from the sellers or the providers where a transaction is concluded, which the recipient of the services expressly acknowledges.
7. Miscellaneous provisions
The nullity, lapse or unenforceability of one of the provisions of the GCS with regard to the legal or regulatory provisions in force shall not affect the validity of the other provisions of these General Conditions, which shall retain their full legal force. In the event that one or more clauses of the GCS were to be declared null, lapsed or unenforceable, the provision(s) concerned shall be replaced by another valid provision of similar scope.
The content of the site or of the services, as well as the General Conditions and the other texts appearing on it, may be modified at any time at the sole discretion of Secundo. The recipient of the services is bound by such modifications, where applicable, and is deemed to take note periodically of the changes made to them.

This site is governed by Belgian law. Only the Courts and Tribunals of the district of Namur have jurisdiction.
